In his autobiography, Federline stated his belief that her previous conservatorship “was the only way to stabilize her situation,” and the third source mentions that Spears’ father “tried telling everyone the conservatorship was in place for her best interest.”

Elizabeth Adinolfi, head of the guardianship practice at Phillips Nizer LLP in New York City, who has no affiliation with Spears, observes that relatives or worried friends “could petition the court at any time if they believe someone who was released from a conservatorship subsequently declines to the point where they meet the legal standard for imposing [one again].” Adinolfi clarifies that this standard implies a person is “unable to provide for their physical health or medical treatment, food, clothing or shelter and/ or is substantially unable to manage his or her own financial resources or resist fraud or undue influence.” Yet, she cautions, “the behaviors need to meet this standard go beyond merely making bad decisions.”

Nina A. Kohn, a distinguished professor of law at Syracuse University, concurs that “the fact that someone makes bad choices doesn’t mean that a court can — or should — impose a conservatorship.” Adinolfi conveys to Us that a renewed conservatorship “seems unlikely,” emphasizing that a solitary DUI conviction would “not be sufficient proof” for the judiciary. The second source indicates that some consider a conservatorship overly drastic: “In a perfect world, [she would have] a steady routine and a treatment plan and for her to be able to trust those around her, which they understand is a big ask after the conservatorship. Even going to the hospital to get her blood tested was a very emotional experience for Britney due to her previous 5150s, so the trauma is very much still there.”

These factors include her blood alcohol level, the presence of any legal or illicit drugs, and the severity of her driving. A blood alcohol concentration (BAC) of .08 percent or above is deemed unlawful in the U.S. Should Spears’ BAC be under this limit and no drugs are detected, Dreiling suggests the case might be dismissed, or she could simply receive a traffic citation. However, if her BAC exceeds .08 and she was speeding or if the DA believes she “seriously put others at risk,” she might face a compulsory two-month jail term. (Reports indicated Spears’ BAC was .06 percent, though official results are still pending.) Defense attorney Michael Cardoza states that the usual penalty for a first-time DUI offense involves probation, along with monetary fines and fees. A source comments, “Everyone is just praying that she doesn’t get jail time for this.” They conclude, “That would be the worst-case scenario.”
